HB 87 is not a good bill. This type of law has already been struck down by the courts and will land the State of Georgia in courts. It is a similar bill to that passed in Arizona. I will let Russell Edwards explain:

As the former Democrat nominee for the U.S. House (GA-10) and current candidate for Treasurer of the Democratic Party of GA, I would like to express my dismay at the ignorance of the GA Republican party that this week introduced an AZ-style immigration bill which contains the exact same provisions that a Federal Court struck down only months ago. This proposed Republican legislation will require state and local law enforcement officers to investigate the immigration status of certain people they “reasonably suspect” of being in the country illegally. An overwhelming majority of jurists across the nation have expressed support for the AZ Federal Court’s decision that this provision as applied will result in a gross violation of the rights of persons to be free from unreasonable search and seizure: a right enshrined in the 4th Amendment of the U.S. Constitution. AZ has to date spent millions of tax-payer dollars defending this law, and it would be a fool’s errand for GA to do the same at this time of severe budget short-falls.

The effects to GA’s tourism and agricultural industries will also be devastating once this law is enacted. AZ has already been blacklisted by national conventions, losing out on millions of dollars in much-needed state revenue. GA, however, has a much larger agricultural industry which will suffer irrevocable harm if we cause the flight of the hard-working immigrants who harvest our food.

As a GA Democrat, I stand in support of GA’s diverse immigrant community and strongly DENOUNCE this unconstitutional legislation.

Finally, I have one important question for GA Republicans. How many jobs will this law create?

Specific provision of GA Republican Immigration Bill (HB 87) which violates the 4th Amendment to the U.S. Constitution:

17-5-100

(b) During any stop of a criminal suspect by a law enforcement officer, where the officer has probable cause to believe that such suspect has committed a criminal offense, including any traffic offense, if, during the lawful detention of such suspect, the officer develops reasonable suspicion to also suspect that such person is an illegal alien, then the officer shall, when reasonably practicable, make an attempt to determine the immigration status of such suspect.

    Under the Mexican law, illegal immigration is a felony, punishable by up to two years in prison. Immigrants who are deported and attempt to re-enter can be imprisoned for 10 years. Visa violators can be sentenced to six-year terms. Mexicans who help illegal immigrants are considered criminals.

    The law also says Mexico can deport foreigners who are deemed detrimental to “economic or national interests,” violate Mexican law, are not “physically or mentally healthy” or lack the “necessary funds for their sustenance” and for their dependents.

    So why don’t we sneak into Mexico and try to live there and hope they turn their heads the other way at our illegal activity by trying not to get caught by the government

    I write to you this morning concern about the enforcement and training of police officers on the Georgia HB87(Georgia Illegal Immigration Reform and Enforcement Act of 2011), which recently became law in Georgia. I am an American citizen as well as a United States Marine who has served for over thirteen years and has recently been station in the state of Georgia. I am Hispanic, and understand that there are many concerns involving the undocumented immigrants working primarily in the fields of Georgia, however, citizens like myself are being affected by this law.

    My concern is that many people like myself will be harass and will have to deal with unnecessary trips to a police station in order to verify that I’m an American, only because I don’t look like many Americans do. According to the law, Officers have immunity over these issues and could apprehend me on a routine traffic violation only because I may look like I’m not legally in my country.

    My concern became stronger last night after I talked to a friend who is also an American citizen and is working temporarily here in Georgia. He was stop on highway 19 between Leesburg and Americus on a speeding violation. He presented his California driving license to the officer but the officer was not satisfied by it since he was in Georgia and did not have a Georgia Identification and took him in to the police station and called ICE (Immigration and Customs Enforcement). ICE verified his information and finally let him go.

    Any other American who does not look Hispanic may have only received a ticket and a court date but many Hispanic Americans like myself will have to suffer abuses from police officers and possibly regular citizens who may not understand that not all Hispanics are here illegally. There are over 50 million Hispanics in my country and from what I read in the news, there may be about 12 million undocumented. Why are we being targets in this state of Georgia?

    Juan, you being a marine, you should know breaking the law is breaking the law. It doesn’t matter if you’re Hispanic or not. If you friend had not been speeding then he wouldn’t have gotten stopped. Simply as that. When you do get stopped and you have a driver’s license from out of state, yes the cops will get suspicious. What do you expect the government to do, just turn their heads and look the other way and act as if illegal immigration is not a problem here if Georgia and elsewhere? The law is the law now you all want to change the law just to please one race. This is not a new bill. It’s just Georgia is just now putting it into action.
